ListInMotion is operated by Unleash Action LLC, a Wyoming limited liability company, doing business as "ListInMotion" ("Company," "we," "us," or "our").

1. Services

Company provides AI-assisted cinematic video production services that transform customer-submitted real estate listing photographs into edited video content ("Services"). All Services are digital and delivered electronically; no physical goods are shipped. The Service provides a finalized video output based on your initial submission. Custom manual revisions or re-edits are not included in the standard Service unless resulting from a technical error on our part.

2. Customer Content

For purposes of these Terms, "Customer Content" means photographs and other materials submitted by you for the purpose of receiving the Services. You retain all ownership rights you have in your Customer Content. By submitting Customer Content, you grant Company a limited, non-exclusive, worldwide, royalty-free license to access, reproduce, transmit, modify, process, and use the Customer Content solely as necessary to provide, produce, deliver, and support the Services, including through third-party service providers used to provide the Services. You represent and warrant that you own or have all necessary rights, licenses, permissions, and consents required to submit the Customer Content and authorize its processing and use as described in these Terms, including any rights relating to property photographs, photographers, property owners, logos, trademarks, and other third-party materials. You agree to indemnify and hold Company harmless from claims, losses, liabilities, damages, and expenses arising from your breach of these representations or warranties.

3. AI-Assisted Processing and Customer Review

The Services involve AI-assisted processing, video generation, and editing. AI-assisted processing may introduce unexpected motion, visual artifacts, or minor variations from the source photographs. Company does not guarantee that every generated visual element will precisely reproduce the source photograph. You are responsible for reviewing the completed video before publishing, distributing, advertising, or otherwise using it, including reviewing property appearance, listing information, branding, and other material details for accuracy and suitability.

4. Marketing Use of Delivered Work

Company may display delivered videos, portions of delivered videos, or other resulting work in its portfolio, website, social media, advertising, or other marketing materials only where the customer has expressly authorized such use, including through an applicable opt-in selection at checkout.

5. Order Process

Orders are placed through our website. Payment is due in full at checkout prior to the commencement of production. After checkout, you will be directed to submit your listing photographs and any other required materials. The production timeline begins once Company has received all photographs and materials reasonably necessary to produce the ordered video ("Complete Submission"). Incomplete, corrupted, inaccessible, or otherwise unusable submissions do not start the delivery timeline. Upon Complete Submission, production begins and the order becomes generally final, subject to the Refund Policy and applicable law.

6. Delivery

Company will use commercially reasonable efforts to deliver completed videos within approximately 24 hours of Complete Submission. Delivery times are estimates and are not guaranteed. Delays resulting from incomplete, incorrect, inaccessible, or replacement-required Customer Content, or circumstances beyond Company's reasonable control, may extend the delivery timeline.

7. No Outcome or Platform Guarantee

Company does not guarantee that the delivered video will result in increased listing views, inquiries, leads, offers, sales, or other business outcomes. Company also does not guarantee that any specific platform, including MLS systems, Zillow, Realtor.com, social media platforms, or other third-party services, will accept, display, or support any particular delivered format. Format specifications offered at the time of purchase reflect Company's current understanding of common platform requirements and may change. It is your sole responsibility to ensure that the delivered video complies with the specific rules, guidelines, and terms of service of your local MLS, brokerage, or chosen publishing platform.

8. Intellectual Property and License to Delivered Video

Upon full payment, Company grants you a non-exclusive, worldwide, perpetual license to use the delivered video for lawful marketing, advertising, promotional, social media, website, and real estate listing purposes. Company retains all rights in its underlying production techniques, workflows, templates, processes, systems, and other proprietary materials. This license does not transfer ownership of or grant rights beyond those available to Company in any third-party materials incorporated into the delivered video. Any such materials remain subject to their applicable rights and license terms.

9. Audio and Music Rights

Videos may include background music provided by Company through royalty-free libraries or third-party automated commercial-use media generators. While these audio tracks are licensed for commercial use, Company does not guarantee that third-party platforms (e.g., Instagram, TikTok, Facebook) will not flag, mute, or restrict the video due to their proprietary automated copyright detection algorithms. Company is not liable for any platform-specific audio restrictions or algorithmic moderation.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Company's total liability for any claim arising out of or relating to the Services shall not exceed the amount actually paid by you for the specific order giving rise to the claim. To the maximum extent permitted by law, Company shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, or lost business opportunities.

11. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles, except to the extent that mandatory consumer protection or contract laws of another jurisdiction apply.

12. Changes

Company may update these Terms from time to time. Changes will become effective when posted on this page unless a different effective date is stated. Orders placed before a change remain governed by the version of the Terms applicable at the time of purchase.
